Terms of Service

By using Via-Registry services, you agree to these Terms of Service. These terms constitute a legally binding agreement between you ("End User") and VIRTUA SYSTEMS SAS ("we", "us", "Via-Registry", "LIR").

General Terms

1.1. Acceptance of Terms

By registering for an account, submitting an application, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1.2. Service Description

Via-Registry provides ASN registration and IPv6 leasing services as a RIPE NCC member (Local Internet Registry). Via-Registry acts as an intermediary between you and RIPE NCC for resource allocation and management.

1.3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements. Organizations must be properly registered in their jurisdiction.

1.4. Account Registration

You must provide accurate, current, and complete information during registration and maintain the accuracy of such information throughout the service period.

End User Responsibilities

Critical Responsibilities

Failure to meet these responsibilities may result in immediate service termination without refund.

2.1. Information Accuracy

  • Provide truthful, accurate, and complete information in all communications and forms
  • Immediately update any changes to your contact information, legal status, or organization details
  • Ensure all documentation submitted is authentic and unaltered
  • Providing false identity or fraudulent information will result in immediate termination and may be reported to relevant authorities

2.2. Compliance and Usage

  • Use allocated resources solely for the stated purpose in your application
  • Comply with all applicable RIPE policies and procedures
  • Maintain valid technical and administrative contacts
  • Ensure resources are used only within the RIPE NCC service region unless otherwise agreed
  • Not sublease, transfer, or allow third-party use of resources without proper authorization

2.3. Abuse Prevention and Prohibited Activities

Zero Tolerance Policy

Any abuse will result in immediate suspension pending investigation. Severe violations result in permanent termination without refund.

Strictly Prohibited Activities:

  • Email/SMS abuse: Spam, bulk mailing, email marketing, harvesting
  • Network attacks: DDoS, port scanning, vulnerability scanning, brute force
  • Malicious content: Malware, viruses, phishing, fraud, scams
  • Copyright violation: Torrenting, piracy, DMCA violations
  • Illegal content: Child exploitation material, terrorism, drugs
  • Resource abuse: IP hijacking, BGP hijacking, route leaking
  • Proxy/VPN: Anonymizing services used for illegal activities
  • False announcements: Announcing IP space you don't own

Abuse Response Procedures:

  • Maintain 24/7 reachable abuse contact (email minimum)
  • Acknowledge abuse reports within 24 hours
  • Provide action plan within 48 hours
  • Resolve issues within 72 hours or as agreed
  • Provide evidence of resolution when requested

Consequences for Violations:

  • First offense: Warning + 24-hour deadline to resolve
  • Second offense: 7-day suspension + €100 reactivation fee
  • Third offense: Permanent termination, no refund
  • Severe violations: Immediate termination + report to authorities

2.4. Communication and Cooperation

  • Respond promptly to Via-Registry requests for information or clarification
  • Provide necessary documentation within requested timeframes
  • Cooperate with RIPE NCC audits or reviews when required
  • Excessive support requests, providing false information, or repeated failures to provide required documentation may result in additional charges of €50 per hour for administrative time

2.5. Identity Verification Requirements

RIPE NCC Due Diligence Requirements

Identity verification is mandatory for ASN registrations as required by RIPE NCC policies.

Identity Verification Process:

  • You must complete identity verification through our approved verification provider
  • Valid government-issued photo ID is required (passport, national ID card, or driver's license)
  • Document must be current and not expired
  • Clear, unobstructed photos or scans are required
  • Information must match your account registration details exactly

Maximum Verification Attempts

You have a maximum of 3 attempts to complete identity verification.

After 3 failed attempts, your registration will be automatically cancelled without refund. This policy is in place to prevent abuse and ensure compliance with RIPE NCC due diligence requirements.

Common Reasons for Verification Failure:

  • Blurry or unreadable document images
  • Expired identification documents
  • Name mismatch between ID and registration
  • Document type not accepted (e.g., student ID, work ID)
  • Altered or fraudulent documents
  • Face not clearly visible in selfie verification

Important: Identity verification failures are not grounds for refund. It is your responsibility to provide valid identification and follow the verification instructions carefully. Multiple failed attempts suggest potential fraud or inability to meet RIPE NCC requirements.

Fees, Payment and Refunds

Payment Deadline

All fees must be paid before the renewal date. Failure to pay will result in resource deallocation and sponsorship revocation.

3.1. Fee Structure

  • ASN Registration: €80 annual service fee + €50 RIPE NCC fee (subject to change)
  • IPv6 Leasing: Varies by block size (see pricing page)
  • All prices are in EUR and exclude VAT where applicable
  • Fees are billed annually in advance

3.2. Payment Terms

  • Payment must be received before the renewal date to maintain services
  • Invoices are sent 30 days before renewal
  • Payment is due upon receipt of invoice
  • Late payments incur interest at the statutory commercial rate
  • Non-payment will result in automatic resource deallocation after grace period

3.3. Refund Policy

NO REFUNDS

Our services are based on time and effort spent processing your requests. Once time has been invested in your application, it cannot be recovered, therefore our fees are non-refundable.

  • Registration and renewal fees are non-refundable
  • No refunds for unused service periods
  • No refunds if RIPE NCC rejects your application
  • No refunds for service termination due to policy violations
  • No refunds for voluntary cancellation

3.4. Reinstatement Fees

  • ASN reinstatement: €30 fee + annual renewal (total €160)
  • IPv6 block reinstatement: Annual renewal fee only (€40-€200)
  • Reinstatement must be completed within 48 hours
  • Resources may be permanently deallocated if not reinstated

3.5. Additional Charges

  • Agreement re-signing due to End User error: €25 per occurrence
  • Excessive support requests (over 5 per month): €50 per hour
  • Emergency processing outside business hours: €100 surcharge
  • Document re-submission due to End User error: €15 per submission
  • Chargeback fee: €80 + any bank fees incurred

Chargeback Warning: Filing a chargeback instead of contacting us will result in immediate service termination, resource deallocation, and permanent ban from our services. The chargeback fee will still be owed even after service termination.

3.5. RIPE Fee Changes

RIPE NCC fees are subject to change based on RIPE General Meeting decisions. Any changes in RIPE fees will be passed through to End Users with no markup. We will notify you of fee changes at least 60 days before they take effect.

Service Terms and Processing

4.1. Business Hours

  • Support Hours: Monday to Friday, 09:00 - 18:00 CET/CEST
  • RIPE NCC Hours: Monday to Friday, 09:00 - 17:00 CET/CEST
  • Holidays: We observe French public holidays and RIPE NCC (Dutch) holidays

4.2. Processing Times

  • Via-Registry review: 1-2 business days after complete documentation
  • RIPE NCC processing: Up to 5 business days after our submission
  • Total ASN registration: Typically 5-7 business days end-to-end
  • IPv6 allocation: Same day if requested before 15:00 CET
  • Support response: Within 2 hours during business hours
  • Agreement processing: 1 business day after receipt

4.3. 30-Day Registration Window

From the moment your payment is received:

  • You have 30 days to complete your entire ASN registration process
  • This 30-day countdown begins immediately upon payment confirmation
  • A warning email will be sent after 25 days if your registration remains incomplete
  • Registrations not completed within 30 days of payment will be automatically closed
  • No refunds will be issued for closed registrations
  • You may start a new registration if your previous one was closed

4.4. Processing Delays

Processing times may be extended due to:

  • RIPE NCC high volume periods (typically end of quarter)
  • Incomplete or incorrect documentation requiring clarification
  • Additional verification requirements from RIPE NCC
  • Technical issues or maintenance windows
  • Force majeure events

Note: We do not guarantee specific processing times. Stated times are typical scenarios under normal conditions.

Policies and Compliance

5.1. RIPE Policy Compliance

Important: RIPE Policies Override These Terms

If RIPE NCC changes their policies, those changes automatically apply to your services. We will implement policy changes as required by RIPE NCC, which may affect your resource eligibility or usage rights.

  • You must comply with all current RIPE policies
  • Policy changes apply immediately upon RIPE NCC implementation
  • Non-compliance may result in resource revocation by RIPE NCC
  • We cannot guarantee resources if you no longer meet policy requirements

5.2. RIPE Database Publication - PUBLIC INFORMATION WARNING

Critical Privacy Notice

ALL information you provide WILL become PUBLIC and searchable on the internet forever:

  • Your full legal name or company name
  • Complete address (street, city, postal code, country)
  • Phone numbers
  • Email addresses
  • Organization details

This information CANNOT be hidden, redacted, or made private. There is NO proxy registration for ASN resources.

  • WHOIS data is publicly accessible via multiple databases and mirrors
  • Search engines index and cache this information permanently
  • Third parties harvest and resell this data
  • You must use real, verifiable information - false data = immediate termination
  • You must keep all information current and accurate
  • Consider using a business address instead of personal residence

5.3. Resource Usage Policies

  • Resources must be used for the purpose stated in your application
  • Multihoming requirement must be maintained for ASN resources
  • Resources cannot be used for illegal activities
  • Email marketing use is strictly prohibited

Limitation of Liability

6.1. No Guarantee of Allocation: We do not guarantee that RIPE NCC will approve your resource request. Application fees are non-refundable regardless of outcome.

6.2. No Routing Guarantee: We do not guarantee that allocated resources will be routable on any part of the Internet. Routing depends on third-party networks beyond our control.

6.3. Limited Liability: Our total liability for any claim shall not exceed the amount paid by you in the 12 months preceding the claim.

6.4. No Consequential Damages: We are not liable for any indirect, special, incidental, or consequential damages, including lost profits or business interruption.

6.5. Third Party Actions: We are not responsible for actions taken by RIPE NCC, including resource revocation or policy changes.

Termination

7.1. Termination by You

  • One month written notice required
  • No refund for unused service period
  • Resources will be deallocated upon termination

7.2. Termination by Us

  • Three months notice for termination without cause
  • Immediate termination for policy violations
  • Immediate termination for non-payment
  • Immediate termination for fraudulent information

7.3. Effect of Termination

  • All resource assignments will be revoked
  • WHOIS records will be deleted
  • You must cease using the resources immediately
  • Outstanding fees remain due and payable

Transfer and Portability

Your Right to Transfer: You own your ASN and can transfer it to another LIR at any time. We will never hold your resources hostage.

8.1. Transferring ASN to Another LIR

Process for transferring your ASN out:

  1. Find new LIR willing to sponsor your resources
  2. Provide 30 days written notice to us
  3. Pay any outstanding fees
  4. Coordinate transfer date with both LIRs
  5. Update RIPE objects during transfer window

Transfer Fee: €0 - We do not charge for outgoing transfers. You must be current on all annual fees until transfer completion.

8.2. Accepting ASN from Another LIR

Process for transferring your ASN to us:

  1. Submit transfer request with current ASN details
  2. Sign our sponsorship agreement
  3. Pay first year fees
  4. We coordinate with your current LIR
  5. Transfer typically completes in 2-3 business days

8.3. Important Transfer Notes

  • ASN must be in good standing (no abuse, valid registration)
  • All RIPE policies must be satisfied
  • Transfer does not reset abuse history
  • BGP sessions and routing must be updated by you
  • We are not responsible for routing issues during transfer

Audit Rights

Compliance Audits: Both we and RIPE NCC have the right to audit your use of resources to ensure policy compliance.

9.1. RIPE NCC Audits

  • RIPE may audit any End User at any time
  • You must cooperate fully with RIPE audits
  • Failure to respond to RIPE audit = resource revocation
  • You must provide requested documentation within deadlines
  • False information to auditors = immediate termination

9.2. Our Audit Rights

  • Annual review of resource utilization
  • Verification of multihoming requirements
  • Confirmation of contact information accuracy
  • Review of abuse complaints and responses
  • Right to request network diagrams and peering proof

9.3. Your Obligations During Audits

  • Respond within 5 business days to audit requests
  • Provide accurate and complete information
  • Grant access to relevant systems if requested
  • Maintain records for at least 2 years
  • Cover any costs related to your audit compliance

Dispute Resolution

10.1. Mediation First

Before initiating any legal proceedings, both parties agree to attempt resolution through mediation:

  1. Written notice of dispute must be sent to the other party
  2. 30-day good faith negotiation period
  3. If unresolved, proceed to formal mediation
  4. Mediation in Paris, France under ICC Mediation Rules
  5. Costs split 50/50 between parties

10.2. Arbitration

If mediation fails, disputes shall be resolved through binding arbitration:

  • Single arbitrator under ICC Arbitration Rules
  • Arbitration venue: Paris, France
  • Language: English or French
  • Arbitrator's decision is final and binding
  • Each party bears its own costs

10.3. Exceptions

Mediation/arbitration not required for:

  • Collection of unpaid fees
  • Injunctive relief for ongoing harm
  • Resource abuse requiring immediate action
  • Criminal activity or fraud

Miscellaneous

11.1. Governing Law: These terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.

11.2. Entire Agreement: These terms, together with any signed agreements, constitute the entire agreement between parties.

11.3. Amendments: We may modify these terms with 30 days notice. Continued use after modification constitutes acceptance.

11.4. Severability: If any provision is found invalid, the remaining provisions shall continue in effect.

11.5. Assignment: You may not assign your rights without our written consent. We may assign our rights to any successor entity.

11.6. Force Majeure: Neither party is liable for delays due to circumstances beyond reasonable control.
